16.2 No Employment Relationship. The Platform does NOT create any employment, agency, partnership, joint venture, or fiduciary relationship between piemied and Users.

16.3 No Investment Opportunity. The Platform is NOT an investment opportunity. Users should not expect to earn money or profit from their participation.

16.4 User Responsibility. Users are solely responsible for their decision to participate in Platform activities. Users should not rely on the Platform as a substitute for employment or income.

Limitation of Liability

17.1 Exclusion of Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL piemied, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• (a) LOSS OF PROFITS, REVENUE, OR BUSINESS;
• (b) LOSS OF DATA OR INFORMATION;
• (c) LOSS OF GOODWILL OR REPUTATION;
• (d) COST OF SUBSTITUTE GOODS OR SERVICES;
• (e) DAMAGES FOR INCONVENIENCE OR EMOTIONAL DISTRESS;
• (f) ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT;
• (g) ANY DAMAGES ARISING FROM LOSS OF POINTS OR FAILURE TO REDEEM.

17.2 Cap on Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF piemied FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE LESSER OF:

• (a) THE TOTAL AMOUNT OF POINTS YOU HAVE EARNED AND REDEEMED IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR
• (b) ONE HUNDRED DOLLARS ($100.00).
